Two (2) Year Limited Warranty on all asphalt installation work.
Payment Terms
True Paving Inc. will provide a written price quote upon request, calculated based on the square footage of the area to be paved and the scope & type of work being performed. Quotes are estimated to the best of our ability based on conditions visible at the time of inspection.
Once the quoted price is accepted by the Customer, a 50% deposit is required to secure the job and begin the permitting process & 811 Dig notifications. The remaining 50% balance is due the day we complete the on-site work.
Please note that our per Square Foot pricing varies depending on the material being removed (e.g., concrete, asphalt, grass or dirt). In rare cases, unforeseen subsurface conditions — such as hidden concrete layers beneath existing asphalt — may require a price adjustment, even after work has begun. This is uncommon but can occur, particularly with older properties that have been previously overlaid or resurfaced.
Property Responsibility
True Paving Inc. is not responsible for damage to lawns, grass, landscaping, concrete, paver bricks, garage floors, treated or stained surfaces, sidewalks, existing asphalt, or siding that may result from equipment access — including crossing, rolling, or driving over these areas during normal installation. While we make every effort to minimize impact, we cannot guarantee that no marks or damage will occur.
If the Customer wishes to retain salvaged materials from the job site and equipment must cross the yard or driveway to accommodate this, any resulting damage is likewise not covered.
Warranty Info
True Paving Inc. stands behind its work with one of the strongest warranties in Western New York. All asphalt installation work carries a two (2) year limited warranty on workmanship and materials, effective from the date of installation. This warranty guarantees that materials and workmanship are free from defects for a period of two years, provided the asphalt is maintained in accordance with our guidelines.
Grading & Drainage
All materials are produced by computerized asphalt plants to ensure consistency in asphalt cement composition, temperature, and aggregate mixtures. Workmanship standards require asphalt to be installed at the designated thickness with proper compaction and drainage. Drainage management may include the use of swales (shallow drainage channels) and berms (raised edges) to direct water flow, as well as skin-lift asphalt patches where necessary. Per industry standards, minor ponding of up to 1/2" may occur in areas where grades are at or below the minimum standard of 0.25" per foot (2% grade). Standing water exceeding 1/2" that does not drain within 48 hours constitutes a drainage issue and will be addressed if less than 85% drainage is achieved. This warranty does not cover issues arising from underground wires, pipes, utilities, culverts, weeds, tree roots, or inadequate sub-base installation performed by others. Damage caused by excessive weight or driving on or near unsupported edges is also excluded. Certain areas must be hand-finished during installation, which may result in a slightly coarser texture compared to machine-finished sections.
To submit a warranty claim, the Customer must notify True Paving Inc. by email at warranty@TruePaving.net within ten (10) days of first discovering the defect. The notification must include photographs of the issue, a brief description, and the approximate date the defect was first observed & under what circumstances it occurred.
Warranty Exclusions
This warranty does not cover damage caused by any of the following:
External impact or foreign objects — motorcycle stands, dumpsters, jacks, kickstands, lawnmowers, lawn chairs, campers, tents or pop-up canopies, bicycles, plow trucks, snow blowers, weed whackers or any similar items.
Chemical exposure — oil, gasoline, or other vehicle fluid spills, drips or tire marks.
Acts of nature — ground movement, drought, soil compaction, root systems, weeds, grass or vegetation growth of any kind, ultraviolet oxidation, and groundwater swelling beneath the pavement.
Failure to seal-coat — Newly installed asphalt must receive a seal-coating application within one (1) year of installation, and that coating must be maintained over the life of the pavement. Failure to do so voids warranty coverage for premature aging, cracking, oxidation, and heat stress damage.
Third-party work — If any contractor other than True Paving Inc. performs paving-related work on the covered area during the warranty period, this warranty is void.
Seal-Coating, Crack Sealing & Line Striping
Seal-coating, crack sealing, and line striping services carry a ninety (90) day limited warranty. This warranty does not cover damage caused by sprinkler systems left running during or after application, tire marks, weather-related damage (rain, wind, hail etc.), or foot traffic (human or animal) across wet sealcoat or paint. There is no warranty on pothole repairs or asphalt patch repairs.
Additional Terms
All materials are purchased and owned by True Paving Inc. until the project is completed and final payment is received in full.
If the project is not paid in full upon completion, this warranty is null and void.
True Paving Inc. reserves the right, at its sole discretion, to repair or replace workmanship and materials in any area(s) of concern.
True Paving Inc. reserves the right to modify warranty terms at the time of bidding, provided any modifications are disclosed in writing on the proposal.
